Terms of Service

1) Social casino; no real-money gambling

• The Service is free-to-play entertainment. It is not real-money gambling.
• Virtual coins/currency/credits and virtual items have no cash value, are not redeemable for cash, and cannot be transferred for value outside the Service.
• No cashout. No prizes of real-world value are offered for play unless expressly stated by us in writing for a specific promotion.

2) Eligibility

You must be at least 20 years old (the minimum age for casino-style gaming under New Zealand standards) and able to form a binding contract under New Zealand law. Do not use the Service if prohibited by law.

3) Accounts & acceptable use

• Provide accurate information and keep your account secure. You are responsible for activity under your account.
• Do not cheat, exploit bugs, manipulate outcomes, use bots/automation, scrape, reverse engineer, or interfere with the Service.
• Do not harass others, post unlawful content, or violate any third-party rights.

4) Virtual items; in-app purchases

We may offer optional purchases of virtual currency/items. Purchases are final to the extent permitted by law and do not create property rights. We may modify, suspend, or remove virtual items, balances, or features for compliance, safety, or integrity of the Service.

5) IP, license

The Service and all content (including software, artwork, trademarks, and gameplay elements) are owned by Spin Kiwis or licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for lawful, non-commercial entertainment.

6) User content & community conduct

If you submit content (e.g., chat, profile info, feedback), you grant us a worldwide, royalty-free license to host, use, reproduce, modify, and display it to operate and improve the Service. You represent you have the rights to what you submit and it does not violate laws or rights of others. We may remove content and moderate at our discretion.

7) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

8) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPIN KIWIS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) NZ$100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

9) Termination

We may suspend or terminate access at any time for suspected violations, safety, fraud prevention, or legal compliance. You may stop using the Service at any time. Sections intended to survive (e.g., IP, disclaimers, limitations, dispute terms) will survive.

10) Disputes; governing law

Please contact us first to resolve issues informally. These Terms are governed by the laws of New Zealand, including the Gambling Act 2003, the Consumer Guarantees Act 1993, and the Fair Trading Act 1986, without regard to conflict-of-law rules. Unless prohibited by law, any dispute will be brought before the Disputes Tribunal of New Zealand or the courts of New Zealand, and you consent to their jurisdiction.

11) Changes

We may update these Terms. If changes are material, we will provide notice by posting updated Terms and updating the “Last updated” date. Continued use after the effective date means you accept the updated Terms.
